MSC Sicilia S.R.L. has adopted a system for the management of reports that can be made by all employees of the Company as well as by all those who come into contact with the same (e.g. suppliers, subcontractors, customers), relating to violations of specific regulations, to guarantee of correctness, transparency and ethics in the conduct of company activities and in compliance with the regulatory provisions referred to in Legislative Decree no. of 10 March 2023. 24 regarding whistleblowing and containing “Implementation of Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons reporting breaches of Union law and laying down provisions concerning the protection of persons reporting breaches of national legislative provisions" (hereinafter the “Whistleblowing Decree”).
The Company has implemented internal reporting channels, the management of which is entrusted to the Reporting Manager. In particular, reports can be transmitted via:
- The IT platform implemented for this purpose, which allows written or oral reports to be made, guaranteeing the protection of the data and identity of the reporter through a communication encryption and voice masking system. Below is the link to access the platform: www.ok.integrityline.com
- Direct meeting, physical or virtual, with the Report Manager at the request of the reporter, in order to directly communicate the subject of the report. This request can be made via the following email address: odvmscsicilia@gmail.com
- Traditional postal address: addressed to the Reporting Manager, Via Trinacria 11, CAP 95030, Catania (CT). Furthermore, it is necessary for the report to be inserted in two closed envelopes: the first with the reporting person's identification data together with a photocopy of the identification document; the second with the report. Both must then be inserted into a third sealed envelope bearing the words "confidential" to the Reporting Manager on the outside.
The reports may concern behavior relating to violations of national provisions which consist of unlawful conduct relevant pursuant to Legislative Decree no. 231/2001 or violations of organizational models.
All reports sent via the channels described above are addressed, received and examined by the Reports Manager of MSC Sicilia.
In particular, MSC Sicilia has identified the Supervisory Body as the managing body of the internal reporting channels, responsible for ensuring compliance with the regulatory requirements regarding the reception, analysis and feedback on the reports received, pursuant to and for the purposes of the Legislative Decree. Legislative Decree no. 24/2023.
MSC Sicilia prohibits and sanctions retaliation against the whistleblower or anyone who makes a report to the judicial or accounting authority or other protected subjects (i.e. facilitator of the whistleblower) and adopts specific measures to ensure that these subjects are not the recipients of retaliation, discrimination or in any case penalties related to reporting.
As part of the management of whistleblowing reports, MSC Sicilia guarantees the confidentiality of the identity of the whistleblower, the person involved and the person mentioned in the report, as well as the content of the report and the related documentation.
The processing of personal data collected as part of the reporting procedure is carried out in full compliance with privacy legislation (GDPR and Privacy Code), consistently with the provisions of Legislative Decree no. 24/2023.
